Record-Setting Verdict in Tractor Trailer Suit

BP LLP lawyers secured a record-setting verdict of $280 million in the case of Judy Madere v. Schnitzer Steel Industries, Inc., Schnitzer Steel Southeast, Inc. & their truck driver on Friday, August 23, 2019. Three generations of a family were killed when a tractor trailer negligently crossed the center line killing 2 children, their mother, grandmother, and their grandmother’s twin sister. Middleton/Ontiveros v. Cooper Tire & Rubber Co. and Audon Ontiveros,  Court of Common Pleas, Hampton County, South Carolina. Wagner vs. Tony Cook Trucking Co. and Estate of Beck. On February 18, 2016, Mr. Wagner was the front seat passenger in a Toyota Corolla as the driver attempted to turn left at on a highway in Banks County, Georgia. The Corolla was violently struck by a dump truck. The driver of the Corolla was killed in the wreck. An investigation determined that the dump truck had brakes that were out of alignment. Kayla Kummala and Madison Fortier v. Downey Trees, Inc. and Jeremy Ryan Stephens. On July 14, 2015, Ms. Kummala was the driver and Ms. Fortier was the backseat passenger of a car stopped at a red light in Forsyth County. A Downey Trees employee, driving a Downey Trees truck, failed to stop at the red light and hit the back of Ms. Kummala’s car going 67 miles per hour. Strickland v. Progressive Express Insurance, James Green and A Plus Flat Rate Logistics, U.S. District Court, Northern District of Georgia.  Wrongful death of 65-year old retiree.  Suit brought against trucking company, driver and trucking company’s insurer.  Insurer took the position that the total policy limits available were $50,000.  After suit was filed seeking a declaration that policy failed to comply with Florida insurance requirements, trucking company insurer settled case for 15 times stated policy limits and pre-suit offer.
